Privacy Policy

DOGOUT, operate this website and our app (Apple App Store and Google Play Store) and collect certain data from our visitors and customers as necessary.

In the following privacy policy, you will learn what we do with your data, so-called personal data, and why we do it. We will also tell you how we protect your data, when the data is deleted and what rights you have in accordance with the UK`s Data Protection Act (DPA) and the General Data Protection Regulation (GDPR).

What are the legal bases of processing?
In accordance with Article 13 of the GDPR, we inform you of the legal basis for our data processing. If the legal basis is not stated, the following applies:
-the legal basis for obtaining consent is Art. 6(1)(a) and Art. 7 GDPR -the legal basis for processing in order to fulfil our services and carry out contractual measures and respond to enquiries is Art. 6(1)(b) GDPR
-the legal basis for processing in order to fulfil our legal obligations is Art. 6(1)(c) GDPR
-the legal basis for processing in order to protect our legitimate interests is Art. 6(1)(f) GDPR. In the event that vital interests of the data subject or another natural person require the processing of personal data, Art. 6 (1) (d) GDPR serves as the legal basis.

You can contact us at any time if you have questions about your data protection rights or would like to assert your rights below:
-Right of withdrawal pursuant to Art. 7 (3) GDPR (e.g., you can contact us if you wish to revoke a previously given consent to a newsletter).
-Right to information according to Art. 15 GDPR (e.g., you can contact us if you would like to know what data we have stored about you)
-Correction according to Art. 16 GDPR (e.g., you can contact us if your email address has changed, and you want us to replace the old email address)
-Deletion according to Art. 17 GDPR (e.g., you can contact us if you want us to delete certain data, we have stored about you) -Restriction of processing according to Art. 18 GDPR (e.g., you can contact us if you do not want us to delete your e-mail address, but only to use it for sending absolutely necessary e-mails).
-Data portability according to Art. 20 GDPR (e.g., you can contact us to receive your data stored with us in a compressed format, e.g., because you want to make the data available to another website)
-Objection according to Art. 21 GDPR (e.g., you can contact us if you do not agree with one of the advertising or analysis procedures specified here)

Deletion of data and storage period
Unless otherwise stated, we delete your data as soon as it is no longer required. Your data will also be blocked or deleted if a storage period prescribed by law expires, unless there is a need to continue storing the data for the conclusion or fulfilment of a contract. Certain data may have to be stored for longer for legal reasons. You can, of course, request information about the stored data at any time.

To close your account and delete all your user data through the DOGOUT app please follow these steps:

1. Open DOGOUT mobile app and log in to your account.
2. Tap on ‘Settings’ icon on home screen in top right corner.
3. In ‘Settings’ tap ‘Delete Account’ button to erase your data.
4. App requires a confirmation step, confirm your decision to delete your account.

Visiting the website
If you merely want to browse our website, we do not collect any personal data, with the exception of the data that your browser transmits to enable you to visit the website, first and foremost:
-IP address -Approximate location based on IP range -Internetprovider -Internet speed -Date and time -Last website visited -Browser -Operating system -Hardware

To protect your privacy, we delete or anonymise the IP address after your visit to our website. This means that the other technical data can no longer be traced back to you and is only used for anonymous statistical purposes to optimise our website. The purpose of the temporary storage of the data is, on the one hand, the technical necessity for establishing the connection and, on the other hand, the correct, error-free presentation of our website. The IP address and the technical data already mentioned are necessary in order to display the website, to prevent display problems for visitors and to correct error messages. The legal basis is the so-called legitimate interest, which has been examined in the context of the aforementioned protective measures as well as in accordance with the requirements from Art. 6 (1) lit. f GDPR.

Contact data or other data provided for the contractual relationship
The purpose of this is to comply with legal obligations (e.g., commercial or tax retention obligations). The legal basis is your consent in accordance with Art. 6 para. 1 p. 1 lit. a GDPR.

The purpose of this is the assertion, exercise, and defence of legal claims, whereby our legitimate interest lies, for example, in the assertion of legal claims and defence in legal disputes. The legal basis is your consent in accordance with Art. 6 (1) sentence 1 lit. a GDPR.

Hosting
This website is hosted by an external service provider (hoster). The personal data collected on this website is stored on the hoster's servers. This may include, but is not limited to, IP addresses, contact requests, meta and communication data, contractual data, contact details, names, website accesses and other data generated via a website. The hoster is used for the purpose of contract fulfilment with our potential and existing customers (Art. 6 para. 1 lit. b GDPR) and in the interest of a secure, fast and efficient provision of our online offer by a professional provider (Art. 6 para. 1 lit. f GDPR). Our hoster will only process your data insofar as this is necessary for the fulfilment of its service obligations and will follow our instructions with regard to this data. In order to ensure data protection-compliant processing, we have concluded a contract on commissioned processing with our hoster.

Cookies
Our website sometimes uses so-called cookies. Cookies are small text files that are usually stored in a folder of your browser. Cookies contain information about the current or last visit to the website. If cookies do not contain an exact expiry date, they are only temporarily stored and automatically deleted as soon as you close your browser or restart the end device. Cookies with an expiry date remain stored even if you close your browser or restart the end device. Such cookies are only removed on the specified date or when you delete them manually.

Google Analytics
We use Google Analytics, a web analytics service provided by Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"). Google Analytics uses the analysis cookies described in our Cookie policy to analyse our website with regard to your usage behaviour. The information generated by cookies about your use of this website will be transmitted to and stored by Google on servers in the United States. However, your IP address is shortened before the usage statistics are analysed so that no conclusions can be drawn about your person. For this purpose, the code "anonymize IP" has been added to Google Analytics on our website to ensure anonymised collection of IP addresses. Google will use the anonymised information obtained through the cookies to evaluate your use of the website, to compile reports on website activities for the website operators and to provide other services associated with the use of the website and the internet. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf.

SSL or TLS encryption
For security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to us as the site operator, this site uses SSL or TLS encryption. You can recognise an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line.
If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Data collection in our app

When you use our app, we collect and store certain data (technically necessary) about you in order to provide services, improve it overall:
-Device identifier as well as user-related device metrics. -Language settings -Mobile data to determine your location -Date and time of use -Operating system (iOS, Android) -Hardware -IP address

To protect your privacy, we delete or anonymise identifiers in our database and most technical data after your use. The purpose of temporarily storing this data is to connect to our servers and to provide the app. The purpose of temporarily storing the IP address is to prevent abuse and harassment or breach of terms of use. The legal basis is the contract with you according to Art. 6 para. 1 lit. b GDPR as well as the legitimate interest according to Art. 6 para. 1 lit. f GDPR. In addition, we apply the above-mentioned security measures to protect your data.

Registration and use of the app
In addition, certain data are required for the registration and use of our app. This is the following data:
-Name -Mail -Password -Gender -Location -Date of birth -Profile Picture

Information about your dog (non-personal data):
-Name -Sex -Breed -Colour -Weight/Size -Date of birth -Gender -Vaccination ID -Microchip ID -Profile picture

To protect your privacy, we delete or anonymise identifiers in our database and most technical data after your use. Usage data is analysed on a statistical basis only and is not personalised.
The purpose of processing this data is to enable the use of the app and its service offerings and functions. The legal basis is the usage contract with you pursuant to Art. 6 (1) lit. b GDPR as well as the legitimate interest pursuant to Art. 6 (1) lit. f GDPR. You can object to data processing based on legitimate interests at any time and explain why your interest outweighs ours. However, it will then unfortunately no longer be possible to use our app. In addition, we apply the above-mentioned security measures to protect your data.

Contact form
You have the option of contacting us via our contact form. The following data will be processed:
-User ID -Email -Name -Message -Time of the request

As a protective measure, contact is made via an encrypted connection. In addition, we apply the principle of data minimisation and only collect the data actually required in the contact form. After successful contact with you and completion of the reason for contact, your data will be deleted. The sole purpose of the data requested is to contact you, which is why the data is only used for this purpose.

Facebook Login
In addition to manual registration, we offer you the option of registering directly with your existing profile on "Facebook". If you wish to use this function, you will be redirected to the Facebook page and navigated through the registration process. With the data transmitted by Facebook, we will of course create your user account without saving your friend lists and contacts. This connection can be removed at any time in the Facebook settings. Further details can be found in Facebook's privacy policy. As a protective measure, the data you enter is transmitted via an encrypted connection. We do not use the registration to access personal data such as friend lists or contacts or to store them for our own purposes. We only store the data that is required for the login and the use of our app that this enables. We do not know what data Facebook collects in the course of registration or how data is linked. The purpose of the requested data is the registration via an existing user account for the use of extended functions in the app. Registration via Facebook is voluntary and can be revoked or the user account cancelled at any time. The legal basis is your consent in accordance with Art. 6 Para. 1 lit. a GDPR.

Apple Sign-In
In addition to manual registration, we offer you the option of registering and logging in directly with your existing profile at "Apple (Apple ID)". If you wish to use this function, you will be redirected to a pop-up from Apple and navigated through the registration process. With the data transmitted by Apple, we create your user account. This connection can be removed at any time in the settings of your iCloud account. For more details, please see Apple's privacy policy.

We do not know which data Apple collects in the course of the login or how data is linked. The legal basis is your consent in accordance with Art. 6 para. 1 lit. a GDPR.

Google Sign-In
In addition to manual registration, we offer you the option of registering and logging in directly with your existing profile on Google. If you wish to use this function, you will be redirected to the Google page and navigated through the registration process. To log in or register, you will be redirected to the Google page where you can log in with your usage data. This links your Google profile or your Google email address and our service. Twitter Sign-In
In addition to manual registration, we offer you the option of registering and logging in directly with your existing profile on Twitter. If you wish to use this function, you will be redirected to the Twitter page and navigated through the registration process. To log in or register, you will be redirected to the Twitter page where you can log in with your usage data. This links your Twitter profile or your Twitter email address and our service. For further information on Twitter Sign-In and privacy settings, please refer to the privacy policy of Twitter. As a protective measure, the data you enter is transmitted via an encrypted connection. We only store the data that is required for the login and the use of our app that this enables. We do not know what data Twitter collects in the course of the login or how data is linked. The purpose of the requested data is the registration via an existing user account for the use of extended functions in the app. Registration via Twitter is voluntary and can be revoked or the user account cancelled at any time. Mobile apps and app authorisations
When you download our app via an app platform (Apple App Store or Google Play Store), you transmit certain information to this platform, in particular your account data, e.g., name, device ID and email address. We have no influence on this data collection and are not responsible for it.

Some features of our app require access to certain features and services on your device. Depending on which mobile operating system you use, you may be required to accept certain app permissions. We will now explain what these permissions are:

Location Data
Access to location data: When you select OK in the "Access Location" pop-up window, you allow the app to collect your location. To protect your privacy, all app permissions are optional, except for the technical permissions required to run the app. You can decline at any time (by clicking "no" or "do not accept"). You can also revoke the permissions subsequently by changing the corresponding settings on your device. The purpose of requesting these permissions is to enable you to use our service and app-specific features. One of the functions and services of our app is to connect with other dog owners in the area, this collection of data is necessary for this purpose. The legal basis is your consent in accordance with Art. 6 (1) lit. a GDPR.

Push notifications
If you select OK in the pop-up window "Allow push notifications", you allow the app to send you notifications. To protect your privacy, all app permissions are optional, except for the technical permissions required to run the app. You can decline at any time (by clicking "no" or "do not accept"). You can also revoke the permissions subsequently by changing the corresponding settings on your device. The purpose of requesting these permissions is to enable you to use our service and app-specific features. One of the features and services of our app is to send you notifications about certain events. These include, but are not limited to, new chat messages and events in the area. The legal basis is your consent in accordance with Art. 6 (1) lit. a GDPR.

Access to media library/photos
If you select OK in the pop-up window "access media library/photos", you allow the app to access your pictures and videos stored on your device. To protect your privacy, all app permissions are optional, except for the technical permissions required to run the app. You can decline at any time (by clicking "no" or "do not accept"). You can also revoke the permissions subsequently by changing the corresponding settings on your device. The purpose of requesting these permissions is to enable you to use our service and app-specific features. One of the functions and services of our app is to share pictures and videos with other users and upload them to the app. The legal basis for this is your consent in accordance with European data protection regulations under Art. 6 (1) lit. a GDPR.

Google Analytics

Google Maps/Google Places
In order to be able to use some functions of our app, we have integrated the map function of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google") via an interface (API). For technical reasons, your IP address is transmitted to Google's servers so that the map showing our location can be displayed in your browser.

The high security standards of the Google platform and the associated privacy policy of Google (http://www.google.com/intl/en/privacy) apply as protective measures. As Google is based in the USA and thus a so-called third country, further guarantees are required to ensure an adequate European level of data protection. Google provides standard contractual clauses by means of which an adequate level of data protection for international data is contractually assured. The standard contractual clauses have been evaluated and jointly agreed.

The purpose of the data transfer is the integration of Google's map function, which is popular among our users and allows various locations to be displayed graphically without having to leave our app. The legal basis is the so-called legitimate interest, which was examined in order to pursue the purpose and within the framework of the aforementioned protective measures, as well as in accordance with Art. 6 (1) lit. f GDPR.

Google Firebase
Our app uses the technology of Google Firebase (Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, "Google"). Firebase is part of the Google Cloud Platform and offers numerous services for developers. A list of these can be found here: https://firebase.google.com/terms/ . Some Firebase services process personal data. In most cases, the personal data is limited to so-called "instance IDs", which are provided with a timestamp. These "Instance IDs" assigned by Firebase are unique and thus allow the linking of different events or processes. This data does not constitute personally identifiable information for us, nor do we make any effort to subsequently personalise it.

For Firebase Analytics, Google also uses the advertising ID of the end device (Android only) in addition to the "instance ID" described above. You can restrict the use of the advertising ID in the device settings of your Android mobile device: Settings > Google > Advertising > Reset advertising ID.

Firebase Cloud Messaging is used to be able to transmit push messages or so-called in-app messages (messages that are only displayed within the respective app). A pseudonymised push reference is assigned to the end device, which serves as the target for the push messages or in-app messages. The push messages can be deactivated and reactivated at any time in the settings of the end device.
Firebase Authentication is a login and authentication service and is a service of Google. Depending on the location from which this application is accessed, the processing location is Ireland or the United States. To facilitate the sign-in and authentication process, Firebase Authentication may use third party identity services and store the information on their platform.

However, it cannot be ruled out that data may also be transferred to the USA. Google provides standard contractual clauses that contractually guarantee an adequate level of data protection for international data.

Assertion, exercise and defence of legal claims
Sometimes it may be necessary for us to process personal data and, where applicable - in accordance with local laws and regulations - sensitive personal data in connection with the exercise or defence of legal claims. Article 9(2) f of the GDPR allows for this when the processing is "necessary for the establishment, exercise or defence of legal claims or when courts are acting in the exercise of their judicial functions"

This may occur, for example, if we need legal advice in relation to legal proceedings or are legally obliged to preserve or disclose certain information as part of the legal proceedings.

Children's personal data
We recognise the importance of children's safety and privacy on the Internet. Our offer is explicitly directed at persons over the age of 16. Should children and young people nevertheless register for our app, they must ensure that this is done with the consent of their parents.

Changes to the privacy policy
We reserve the right to change this privacy policy at any time, but we will always comply with applicable data protection laws. We recommend that you check the current privacy policy each time you visit the websites and the app.
